Abstract
China has passed progressively stricter environmental policy since the 1970’s. Even with the passing of this legislation, and a recent crackdown on corruption at the local level, China’s emission levels continue to rise. This paper aims to test the application of the normative theory of regulation and the positive theory of regulation to the increase in the number of legal entities in the management of water conservancy, environment and public facilities as a proxy for monitoring in ten provinces in China. The results indicate that both theories can be used to explain the increase in legal entities in ten provinces, validating the narrative that while environmental regulations can contribute to environmental preservation, this is always weighed against the economic costs associated with it.
