Abstract
This presentation examines why the U.S. government designated MS-13 as a Foreign Terrorist Organization in February 2025, arguing that the designation represents a fundamental departure from three decades of FTO precedent and serves purposes far removed from counterterrorism. Analyzing the State Department's designation announcements from 1997 to 2025 alongside the government's seventeen-year documentary record on MS-13, the project demonstrates that MS-13 lacks the political, religious, or ideological motivation that has consistently characterized every organization previously added to the FTO list. The gang's documented violence serves criminal purposes: gang advancement, protection of illicit interests, internal discipline, and rivalry elimination. The timing of the designation presents an additional paradox: it came not during escalation but after MS-13's operational capacity had been substantially degraded under President Nayib Bukele's security campaign in El Salvador, with tens of thousands of members imprisoned and communication networks disrupted. Moreover, the existing criminal justice system was already effectively dismantling MS-13 through RICO prosecutions and international cooperation, all without an FTO label. The designation's true effects lie not in law enforcement but in the administrative and immigration consequences it triggers: deportation for anyone deemed associated, indefinite detention without charge, secret evidence, and expanded surveillance. These tools target not just gang members but immigrant communities, establishing a precedent for expanding the FTO framework to cartels and other organizations, with devastating constitutional consequences now visible in mass deportations to El Salvador's CECOT prison and mass detention in secretive detention facilities within the United States, including Guantanamo Bay.
